Changes in Law

In Illinois, the law governing the payment of Maintenance (formerly called “Alimony”) has changed on five separate occasions in the past five years; once on January 1, 2015, on January 1, 2016, on January 1, 2017, on June 1, 2018, and again on June 1, 2019!   These dizzying changes in this aspect of Divorce Law require lawyers practicing in this area to remain current, and up to speed on all aspects involving the payment of Maintenance.  For example, what if you were divorced in 2017, but you wish to return to court in 2020 to request an increase in your monthly maintenance, or to the contrary, seek a reduction in your obligation to pay Maintenance to your former spouse?  Does the court look to the law in effect in 2017 when the divorce became final, or does the court look to the current law today?
